TERMS OF USE

1. Definitions and Interpretation

In these Terms of Use (“Terms”):

  • Website” means the website located at www.kinetixrehab.co.uk and all associated sub-domains, content and functionality;

  • We, us, our” means Jack Lewington trading as Kinetix Rehabilitation, a sole-trader practice providing mobile sports-rehabilitation and massage therapy services across Berkshire and Oxfordshire, United Kingdom;

  • You, your” means any person accessing, browsing or using the Website;

  • Content” means all text, graphics, images, video, audio, data, design, layout and other material appearing on or forming part of the Website;

  • Service Terms” refers to the Terms and Conditions of Service displayed below;

  • References to statutes include amendments and re-enactments thereof.


2. Acceptance of Terms

2.1 By accessing or using the Website you agree to be bound by these Terms of Use, the Service Terms, and our Privacy & Cookies Policy.
2.2 If you do not agree, you must cease using the Website immediately.
2.3 We reserve the right to amend these Terms at any time without notice; continued use of the Website constitutes acceptance of the amended Terms.


3. Access and Availability

3.1 We endeavour to ensure the Website is available at all times but do not guarantee uninterrupted or error-free access.
3.2 We may suspend, withdraw or modify any part of the Website without liability or notice.
3.3 Access is provided free of charge for personal, non-commercial use within the United Kingdom; users accessing from other jurisdictions are responsible for compliance with local law.


4. Intellectual Property Rights

4.1 All intellectual-property rights in the Website and its Content (including, without limitation, copyright, design rights, trademarks, trade names, and database rights) belong to Jack Lewington t/a Kinetix Rehabilitation or its licensors.
4.2 You may view, download, and print material for personal reference only and may not copy, reproduce, modify, distribute, publish or commercially exploit any Content without prior written consent.
4.3 The name “Kinetix Rehabilitation”, the Kinetix Rehab logo and all related graphics are proprietary marks; unauthorised use is strictly prohibited.


5. Acceptable Use

You agree that you will not:
a) use the Website for any unlawful, fraudulent or malicious purpose;
b) attempt to gain unauthorised access to the Website, its servers or connected systems;
c) introduce viruses, trojans, worms or other harmful code;
d) use automated scripts, robots, crawlers or scraping tools to access or copy Content;
e) post or transmit material that is defamatory, obscene, discriminatory or infringing; or
f) take any action which imposes an unreasonable load on our infrastructure.

We may suspend or terminate access if these conditions are breached.


6. Accuracy of Information

6.1 While reasonable efforts are made to ensure accuracy, Content on the Website is provided for general information only and should not be relied upon as professional, medical or diagnostic advice.
6.2 You should obtain specific assessment from a qualified practitioner before acting on any information.
6.3 We make no representation or warranty (express or implied) as to completeness, reliability or fitness for a particular purpose.


7. External Links and Third-Party Material

7.1 The Website may include links to third-party websites (including Google Maps, Trust Index, Mailchimp, Rehab Guru and Amelia). These are provided solely for convenience.
7.2 We do not control, endorse or accept responsibility for the content or availability of external sites.
7.3 Use of such sites is at your own risk and subject to their respective terms and privacy policies.


8. Social-Media Interaction

8.1 Engagement via social-media platforms (e.g., Instagram @KinetixRehab or other accounts operated by us) is governed by these Terms and the platform’s own rules.
8.2 We will never request sensitive or payment information through social media. Users providing personal data via such platforms do so at their own risk.


9. Liability and Disclaimer

9.1 Except for liability that cannot be excluded in law (including death or personal injury caused by negligence), we exclude all liability for any direct, indirect or consequential loss arising from use of the Website or reliance upon its Content.
9.2 We do not warrant that the Website or any linked site is free from errors, defects, viruses or malicious code.
9.3 You are responsible for ensuring your own device security, data back-up and antivirus protection.


10. Submissions and Feedback

10.1 Any information, feedback or material you submit through the Website (excluding personal-data submissions governed by our Privacy Policy) shall be deemed non-confidential and non-proprietary.
10.2 We may use such material for any purpose without obligation or payment to you.
10.3 Do not send commercially sensitive or confidential information via web forms unless expressly requested.


11. Payment Portals and E-Commerce

11.1 Where the Website enables you to make payments or bookings, such transactions are processed via Amelia Booking, Stripe, PayPal, or Rehab Guru using encrypted, PCI-DSS-compliant systems.
11.2 We do not store full card details and are not liable for any breach occurring within those third-party networks.
11.3 All purchases and bookings are governed by the Terms and Conditions of Service set out in Part B below.


12. Complaints and Dispute Resolution

12.1 Any Website-related complaint should first be addressed in writing to jack@kinetixrehab.co.uk.
12.2 If unresolved, you may escalate the matter to BASRaT or the Information Commissioner’s Office (for data-protection issues).
12.3 We will endeavour to respond within 21 working days.


13. Governing Law and Jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of England and Wales, and you irrevocably submit to the exclusive jurisdiction of the English courts.

Part B – TERMS AND CONDITIONS OF SERVICE

1. Parties

These Terms and Conditions (“Terms”) constitute a legally binding agreement between Jack Lewington trading as Kinetix Rehabilitation (“the Practitioner”, “we”, “us”, “our”) and the individual or organisation booking or receiving services (“the Client”, “you”, “your”).

By making a booking, payment, or otherwise engaging our services, you agree to be bound by these Terms.


2. Scope of Services

Kinetix Rehabilitation provides professional sports-rehabilitation, injury-assessment, exercise-therapy and massage treatments, including:

  • In-person mobile appointments at the Client’s home, workplace or sports facility;

  • Clinic-based sessions (where arranged); and

  • Online or digital rehabilitation programmes delivered via Rehab Guru.

All services are delivered personally by Jack Lewington, a BASRaT-registered Sports Rehabilitator and insured professional practitioner.


3. Professional Standards

All clinical practice shall conform to the British Association of Sport Rehabilitators and Trainers (BASRaT) Code of Professional Conduct and the standards of the Practitioner’s insurer.

We are not medical doctors and do not provide medical diagnosis beyond our professional scope. Where appropriate, clients may be referred to their GP or another healthcare professional.


4. Bookings and Appointments

4.1 Appointments may be booked:

  • Online through the Amelia Booking system on our website;

  • Via telephone, email or direct message; or

  • By arrangement in person.

4.2 Online bookings are confirmed only once payment or deposit (if required) has been received.

4.3 Upon booking, you will receive confirmation by email or SMS. Please review all details and notify us immediately of any error.

4.4 We reserve the right to refuse treatment if, in our professional opinion, it is unsafe or contraindicated.


5. Payments

5.1 Payment may be made by:

  • Secure online payment through Amelia Booking (Stripe/PayPal);

  • Online invoice issued by the Practitioner;

  • Payment through Rehab Guru for digital programmes; or

  • Cash or card at the appointment.

5.2 All prices are stated in Pounds Sterling (GBP) and are inclusive of any applicable taxes unless otherwise indicated.

5.3 Payment is due at the time of booking or immediately following treatment, unless an alternative arrangement has been agreed in writing.

5.4 Invoices must be settled within seven (7) days of issue. Late payment may incur interest under the Late Payment of Commercial Debts (Interest) Act 1998.


6. Cancellations and Missed Appointments

6.1 Cancellations must be made at least 24 hours prior to the scheduled appointment time.

6.2 Cancellations made within 24 hours or non-attendance without notice may be charged at 100 % of the appointment fee.

6.3 If we need to cancel or reschedule, as much notice as reasonably possible will be given, and any pre-paid fees will be refunded or transferred to a new booking.


7. Client Responsibilities and Contraindications

7.1 You agree to:

  • Provide complete and accurate information regarding your health, injury history and medication;

  • Inform us of any change in medical condition before each appointment;

  • Follow any rehabilitation or after-care advice given.

7.2 You acknowledge that:

  • Treatments may involve physical contact;

  • Temporary soreness or bruising may occur; and

  • Results cannot be guaranteed.

7.3 We reserve the right to decline or terminate treatment if contraindications arise or if professional boundaries are not respected.


8. Mobile Appointments and Access

8.1 For home or venue visits, the Client must ensure a clean, safe and accessible environment with sufficient space for a portable treatment couch.

8.2 Parking and access details must be provided in advance. Where reasonable parking costs are incurred, these may be added to the appointment fee.


9. Health and Safety

The Practitioner maintains full first-aid certification (PHICIS Level 2) and carries basic first-aid equipment.

All equipment is sanitised between appointments in compliance with infection-control standards.

Clients exhibiting symptoms of contagious illness may be refused treatment.


10. Liability

10.1 All services are carried out with reasonable skill, care and diligence consistent with professional practice.

10.2 Except for liability that cannot be excluded by law (including death or personal injury caused by negligence), we shall not be liable for:

  • Loss or damage arising from inaccurate or incomplete information supplied by the Client;

  • Any indirect, consequential or economic loss; or

  • Any loss of profits, business or reputation.

10.3 Total liability, whether in contract, tort or otherwise, shall not exceed the amount paid for the specific session giving rise to the claim.

10.4 Nothing in these Terms affects statutory rights under the Consumer Rights Act 2015.


11. Insurance

Kinetix Rehabilitation is fully insured for professional indemnity and public liability through an approved BASRaT-recognised insurer. Evidence of cover can be provided upon request.


12. Confidentiality and Data Protection

All client information and clinical notes are confidential and handled in accordance with the Privacy & Cookies Policy and the UK GDPR. Records will not be shared with third parties without your explicit consent, except where required by law or professional duty.


13. Vouchers and Promotions

Gift vouchers or promotional discounts are valid only for the period specified and are non-transferable, non-refundable and have no cash value. Expired vouchers will not be honoured.

15. Force Majeure

We shall not be liable for delay or failure to perform obligations caused by events beyond reasonable control, including illness, accident, natural disaster, or network failure.


16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the English courts.


17. Variation

We may update these Terms at any time. The most current version will be displayed on our Website and shall supersede all previous versions.
